Arizona’s rules, with sources

State form
  • Arizona Revised Statutes Section 28-2058 has the seller of a registered vehicle endorse an assignment with warranty of title on the certificate of title or a title transfer form.1
  • Arizona law directs ADOT or an authorized third party to provide assignment and warranty forms that include the odometer mileage disclosure statement.3
  • An Arizona seller must hand the buyer an odometer mileage disclosure statement in the form the ADOT director prescribes, whether or not the vehicle is registered.1
Signing
  • Arizona Revised Statutes Section 28-370 lets designated ADOT employees administer oaths and acknowledge signatures free of charge in matters the department enforces.2
  • A power of attorney used only for Arizona title and registration work needs no notary when a designated ADOT employee witnesses it, and needs no witness when it is notarized.2
Deadlines
  • Arizona requires the buyer to present the signed title or title transfer form to ADOT, with the fee, within fifteen days after the transfer.1
  • Within thirty days of an Arizona sale, the seller moves the plates to another vehicle, surrenders them or files an affidavit of license plate destruction.1
  • ADOT tells Arizona sellers to complete a sold notice right away when a vehicle is sold or transferred.4
Where it is filed
  • An Arizona seller delivers the signed-over title or title transfer form to the buyer at the moment the vehicle itself is delivered.1
  • Until ADOT records the ownership change, the Arizona buyer must display a temporary registration plate, another permit or a valid license plate on the vehicle.1
Taxes and fees
  • ADOT collects any use tax due when the title transfer is applied for and does not process the transfer until that tax is paid.5
  • Arizona plates stay with the seller, who can claim a credit for the unexpired vehicle license tax and fees, minus a twelve dollar processing fee.6
  • If an Arizona seller waits more than thirty days after the transfer to claim the registration credit, the unexpired amount keeps shrinking until the claim is made.6
Law
  • Arizona exempts from the odometer statement vehicles of model year 2010 or older once ten model years old, and model year 2011 or newer once twenty model years old.1

Questions about an Arizona bill of sale

What does an Arizona seller hand the buyer?

The certificate of title, or a title transfer form, signed with an assignment and warranty of title, delivered when the vehicle changes hands. Unless the vehicle is old enough to be exempt, the seller also gives an odometer mileage disclosure statement on the form ADOT prescribes.

Those are the papers Section 28-2058 names. A written bill of sale adds a private record of the price, the date and both parties.1,3

How long does an Arizona buyer have to transfer the title?

Fifteen days after the transfer. The buyer presents the signed-over title or title transfer form to ADOT with the fee, and ADOT issues a new certificate of title and, when needed, new plates.

Until the ownership change is on ADOT’s records, the vehicle carries a temporary registration plate, another permit or a valid plate.1

What does an Arizona seller do after the sale?

ADOT asks for a sold notice right away. Within thirty days, the plates go on another vehicle, back to ADOT or an authorized third party, or are reported destroyed by affidavit.

Because the plates stay with the seller, the seller can apply for a credit of the unexpired vehicle license tax and fees, minus a $12 processing fee; waiting past thirty days shrinks that credit.1,4,6

Can ADOT witness or acknowledge signatures for a vehicle sale?

Yes, for its own matters. Section 28-370 lets employees designated by the ADOT director administer oaths and acknowledge signatures without a fee.

A power of attorney limited to title and registration work can be witnessed by a designated ADOT employee instead of notarized, and a notarized one needs no witness.2

What to have at hand

  • Vehicle identification number (VIN), year, make, model and plate
  • Odometer reading on the day of sale
  • Sale price, or the value if it is a gift
  • Full legal names and addresses of seller and buyer

It does not replace the title. Ownership moves when the signed title and the state’s title application reach the motor vehicle agency.

Frequently asked questions

Do Arizona license plates go with the car when it is sold?

No. Section 28-2356 has the seller keep the plates. Within thirty days the seller transfers them to another vehicle, surrenders them or files an affidavit of destruction, and the buyer displays a temporary registration plate, another permit or a valid plate until ADOT records the new owner.1,6

When does an Arizona buyer pay tax on a used vehicle?

Any use tax that applies is collected when the buyer applies for the title transfer, and ADOT will not process the application until that tax is paid.5
