Under chapter 185, section 110, as quoted by the Massachusetts Land Court, a power of attorney for registered land is acknowledged, filed with the registry district recorder and registered, and so is any revocation.2

Massachusetts’ rules, with sources
- State form
- Under Massachusetts General Laws chapter 190B, section 5-501, a power of attorney is durable when it says, for example, “This power of attorney shall not be affected by subsequent disability or incapacity of the principal, or lapse of time,” or uses similar words.3
- Massachusetts law also allows a springing durable power with the words “This power of attorney shall become effective upon the disability or incapacity of the principal.”3
- The Massachusetts RMV publishes form TTLREG109, the Vehicle Owner’s Limited Power of Attorney, which can only be used for RMV transactions.4
- The Massachusetts RMV accepts either its own form TTLREG109 or any free-form power of attorney that meets Massachusetts legal requirements.5
- For tax matters, the Massachusetts Department of Revenue generally accepts a power of attorney only on Form M-2848.6
- Signing
- Under Massachusetts General Laws chapter 183, section 32, the law on acknowledging and recording deeds also applies to a letter of attorney used to convey real estate.1
- The Massachusetts Land Court requires a power of attorney used to convey registered land to carry an acknowledgment substantially in the form of chapter 222, section 15(b), with satisfactory evidence of identity and a statement that it was signed voluntarily.2
- The Massachusetts Land Court applies that acknowledgment rule whether the power of attorney was notarized in Massachusetts or in another state.2
- The Massachusetts RMV accepts electronic signatures on a power of attorney except when it has a witness signature, in which case every signature must be handwritten.5
- On the Massachusetts RMV limited power of attorney form, the principal, the agent and a witness for each owner’s signature all sign by hand.5
- An agent signing Massachusetts RMV documents under a power of attorney must write “P.O.A.” next to each signature.5
- Deadlines
- A Massachusetts durable power of attorney does not lapse with time unless the document states when it ends.7
- In Massachusetts, the principal’s death does not cut off an agent who, without actual knowledge of the death, acts in good faith under a written power of attorney.8
- The Massachusetts RMV limited power of attorney expires 30 days after it is signed or when the registration or title is processed, whichever comes first.4
- The Massachusetts Department of Revenue asks for 2 business days to attach a Form M-2848 to the taxpayer’s account.6
- Where it is filed
- Under chapter 185, section 110, as quoted by the Massachusetts Land Court, a power of attorney for registered land is acknowledged, filed with the registry district recorder and registered, and so is any revocation.2
- Since February 2, 2026, the Massachusetts Land Court refuses to register a power of attorney whose powers depend on an off-record document or another vague reference.9
- A third party in Massachusetts is treated as knowing of a revocation only once it is in a writing signed by the principal or a personal representative and actually received, or, in a real estate transaction, recorded under chapter 184, section 25.8
- When a Massachusetts agent signs a recordable document, the agent’s affidavit that the power was still in force can be recorded with it.10
- A Massachusetts taxpayer does not need to file a power of attorney with the Department of Revenue unless a matter requires contact with DOR employees.6
- Law
- Acts an agent takes under a Massachusetts durable power of attorney while the principal is incapacitated bind the principal as if the principal were competent.7
- If a Massachusetts court later appoints a conservator for the principal’s property, the agent answers to the conservator, who can revoke or amend the power of attorney.11
- A Massachusetts durable power of attorney can nominate a conservator or guardian, and the court follows the most recent nomination unless there is good cause or disqualification.11
- In Massachusetts, the agent’s affidavit that the agent did not know of a revocation, death or incapacity is conclusive proof that the power was still in effect for good-faith acts.10
- Massachusetts General Laws chapter 190B, section 5-506 lets the agent sue for damages when a third party unreasonably refuses a valid durable power of attorney.12
- A third party that relies in good faith on a Massachusetts durable power of attorney is not liable for acting on it.13
- The Massachusetts RMV never transfers a vehicle title to the agent named in the power of attorney.5
- The Massachusetts RMV stops accepting a power of attorney once it learns the principal has died.5
- A Massachusetts health care proxy, the separate document for medical decisions under chapter 201D, is signed in the presence of two adults who sign as witnesses.14

Questions about a Massachusetts power of attorney
What makes a Massachusetts power of attorney durable?
The words in it. Chapter 190B, section 5-501 calls a power durable when the writing says it “shall not be affected by subsequent disability or incapacity of the principal, or lapse of time,” or that it “shall become effective upon the disability or incapacity of the principal,” or similar words.
With that wording, what the agent does during the principal’s incapacity binds the principal as if the principal were competent, and the power does not lapse with time unless the document sets an end date.3,7
Does a Massachusetts power of attorney have to be notarized?
Sections 5-501 to 5-507 of chapter 190B cover durable wording, revocation and reliance, without a signing ceremony of their own. State law does call for an acknowledgment when the power is used for real estate: chapter 183, section 32 applies the deed rules on acknowledgment and recording to a letter of attorney for the conveyance of land.
For registered land, the Land Court requires the Massachusetts statutory acknowledgment form of chapter 222, section 15(b), even when the power was notarized in another state. Agencies add their own rules: the RMV form needs a witness for each owner’s signature, all handwritten.1,2,5
Where is a Massachusetts power of attorney recorded?
Recording comes up when the power is used for land. A letter of attorney to convey real estate follows the deed rules on acknowledgment and recording; for registered land it is acknowledged, filed with the recorder of the Land Court registry district and registered, and a revocation goes through the same steps.
Since February 2, 2026, the Land Court rejects a power whose authority depends on an off-record document, such as a servicing agreement: the power itself must list what the agent can sign. When the agent signs a recordable document, the agent’s affidavit that the power was still in force is recordable too.1,2,9,10
Which Massachusetts agencies have their own power of attorney form?
The RMV has form TTLREG109, the Vehicle Owner’s Limited Power of Attorney, valid only for RMV registration and title work and expiring after 30 days or once the transaction is processed. The RMV also accepts a free-form power that meets Massachusetts legal requirements, but it will not transfer a title to the agent.
The Department of Revenue generally accepts a power of attorney for tax matters only on Form M-2848, and a new M-2848 or a signed statement revokes it.4–6
How is a Massachusetts health care proxy different?
Medical decisions have their own document in Massachusetts, the health care proxy under chapter 201D. It is signed in front of two adult witnesses, who affirm the principal appeared to be at least 18, of sound mind and under no constraint, and the named health care agent cannot be one of them.14
What to have at hand
- Full legal names and addresses of principal and agent
- Which powers the agent gets, and any limits
- When it starts and whether it continues if the principal becomes incapacitated
- A successor agent, if you want one
Health care decisions usually take a separate document (a health care power of attorney or advance directive).
Frequently asked questions
Does a Massachusetts power of attorney end when the principal dies?
Chapter 190B, section 5-504 says the death does not revoke the agency as to an agent or other person who, without actual knowledge of the death, acts in good faith under the power, and those acts bind the principal’s successors. The RMV stops accepting a power once it learns the principal has died.5,8
When does revoking a Massachusetts power of attorney reach third parties?
Chapter 190B, section 5-504 protects third parties until they actually receive a written revocation signed by the principal or a personal representative or, in a real estate transaction, until the revocation is recorded under chapter 184, section 25. For registered land, the revocation is acknowledged and registered like the power itself; for tax matters, a new Form M-2848 or a signed statement to the Department of Revenue revokes the earlier one.2,6,8
