Michigan’s rules, with sources

State form
  • Michigan’s State Court Administrative Office approved Form DC 100c, Notice to Quit to Recover Possession of Property, which cites MCL 554.134(1) or (3).1
  • After a foreclosure, the Michigan form notes that the landlord must give the notice the lease requires or at least one rental period, unless the law allows otherwise.1
Deadlines
  • Under Michigan Compiled Laws Section 554.134(1), either party may end a tenancy at will with one month’s notice; when rent is paid at intervals shorter than three months, notice equal to that interval is enough.2
  • A Michigan notice is not void because its end date falls mid-period; the tenancy then ends after a span equal to the interval between rent payments.2
  • A Michigan year-to-year tenancy ends one year after the notice to quit is served.2
Delivering the notice
  • The DC 100c certificate of service covers personal delivery, delivery at the premises to a household member or employee of suitable age, first-class mail, and electronic service the tenant consented to in writing.1

Questions about a Michigan termination notice

How much notice ends a month-to-month tenancy in Michigan?

One month, or for rent paid more often than every three months, notice equal to the time between payments. A notice that names a day in the middle of a rental period still works; the tenancy simply ends after one full payment interval.

A year-to-year tenancy is different: the notice ends it one year after service.2

Which form does a Michigan landlord use to end a month-to-month tenancy?

Form DC 100c, Notice to Quit to Recover Possession of Property, approved by the State Court Administrative Office and free on the Michigan courts’ website. The landlord fills in the move-out date, signs it and completes the certificate of service, which lists the accepted delivery methods.1

What to have at hand

  • Property address, unit and county
  • The date the tenancy began
  • The last day of the tenancy, counted from your state’s notice period
  • A mailing address where the tenant returns keys and sends a forwarding address

It is not for late rent or a lease violation, which take a different notice, and it does not end a fixed-term lease before its end date.
