Illinois’ rules, with sources

State form
  • Illinois’ Supreme Court-approved Notice of Non-Renewal of Lease or Termination of Tenancy, form E-TN 3506.2, is known as the 30-Day Notice.1
  • Every Illinois court must accept the eviction forms on the approved statewide list.3
Deadlines
  • On the approved Illinois form, the landlord states that the notice is served at least 30 days before the tenancy ends, and the form itself warns that a lease or local law may require longer.1
Delivering the notice
  • An Illinois termination notice can be handed to the tenant, left with a resident 13 or older, or sent by certified or registered mail with a return receipt.4
Law
  • Chicago’s Fair Notice Ordinance requires 60 days’ notice to end a tenancy of more than six months and under three years, and 120 days after three years.2
  • The Chicago notice periods cover month-to-month renters as well as tenants with a written year-long lease.2
  • When a Chicago landlord gives too little notice, the tenant may stay for the required period or keep paying the prior rent for that period.2

Questions about an Illinois termination notice

How much notice ends a month-to-month tenancy in Illinois?

Outside cities with their own rules, 30 days: the Illinois Supreme Court’s approved form is the 30-Day Notice, and it reminds landlords that a lease or local law can demand more.

Chicago demands more. Its Fair Notice Ordinance sets 60 days for a tenant who has lived in the unit more than six months but under three years, and 120 days after three years, for month-to-month renters too.1,2

Where is the official Illinois 30-day notice form?

On the Illinois Courts eviction forms page, as form E-TN 3506.2, Notice of Non-Renewal of Lease or Termination of Tenancy, free to download with the affidavit of service. Every Illinois court has to accept it.1,3

What to have at hand

  • Property address, unit and county
  • The date the tenancy began
  • The last day of the tenancy, counted from your state’s notice period
  • A mailing address where the tenant returns keys and sends a forwarding address

It is not for late rent or a lease violation, which take a different notice, and it does not end a fixed-term lease before its end date.
