Florida’s rules, with sources
- Deadlines
- Under Florida Statutes Section 83.57(3), either side ends a month-to-month tenancy with at least 30 days’ written notice before the end of a monthly period.1
- Florida sets shorter or longer periods for other rental cycles: 7 days for week to week, 30 days for quarter to quarter and 60 days for year to year.1
- Delivering the notice
- Florida requires the month-to-month termination notice in writing and delivered the way Section 83.56(4) describes.1
- Those Florida delivery methods are mailing, handing over a true copy, email under Section 83.505, or leaving a copy at the residence when the tenant is absent.2
- Email counts as delivery in Florida only after both parties sign a lease addendum electing it, and either may revoke that choice in writing.3
- Law
- Florida Statutes Section 83.425 overrides local government rules on residential tenancies, expressly including notice requirements.4
Questions about a Florida termination notice
How much notice ends a month-to-month lease in Florida?
At least 30 days, timed to the end of a monthly rental period. With rent due on the first, a notice delivered on May 20 comes too late to end the tenancy on May 31, but early enough to end it on June 30.
The same 30-day rule binds a tenant who wants to leave. Year-to-year tenancies need 60 days, quarterly ones 30 and weekly ones 7.1
How is a Florida notice to end a month-to-month tenancy delivered?
In writing, by mail, by handing over a copy, by email when both sides signed the email addendum, or by leaving a copy at the home if the tenant is away. Keeping a note of the date and method helps if the tenant does not leave.
Because Section 83.425 preempts local notice rules, Florida cities and counties cannot require a longer notice for this.1–4
What to have at hand
- Property address, unit and county
- The date the tenancy began
- The last day of the tenancy, counted from your state’s notice period
- A mailing address where the tenant returns keys and sends a forwarding address
It is not for late rent or a lease violation, which take a different notice, and it does not end a fixed-term lease before its end date.
