Florida’s rules, with sources

State form
  • Florida law prescribes the wording of the notice: the amount owed for the rent and use of the premises, the address with the county, the exact deadline date, and the landlord’s name, address and phone number.1
  • The landlord-tenant forms published by The Florida Bar have been approved by the Florida Supreme Court.3
  • Form 1, the Florida notice from landlord to tenant for failure to pay rent, is approved for use under Rule 10-2.1(a) of the Rules Regulating The Florida Bar and is free to download.2
Deadlines
  • Florida Statutes Section 83.56(3) lets a landlord end the rental agreement when rent stays unpaid for 3 days, excluding Saturday, Sunday and legal holidays, after a written demand for the rent or possession.1
  • For the Florida three-day count, only holidays the courts observe are treated as legal holidays.1
Delivering the notice
  • A Florida three-day notice is delivered by mail, by handing over a true copy, by email under Section 83.505, or, when the tenant is away, by leaving a copy at the residence; the lease cannot waive these rules.1
  • Florida allows notices by email only when landlord and tenant signed a lease addendum choosing email delivery and each gave a valid email address.4
Law
  • A Florida landlord who takes partial rent after posting the notice must give a receipt with the new balance and date, deposit the partial rent with the court on filing, or post a new three-day notice.1
  • Since 2023, Florida Statutes Section 83.425 has preempted local landlord-tenant rules, naming notice requirements among the matters reserved to the state.5

Questions about a Florida pay-or-quit notice

How many days does a Florida tenant have after a three-day notice?

Three days after delivery, skipping Saturdays, Sundays and court-observed holidays. Delivered on a Thursday, for example, the notice runs Friday, Monday and Tuesday, so the deadline date written on it is that Tuesday.

The notice must name that date. The Florida Bar’s form instructions also point out that a written lease may promise a longer period than three days.1,2

Does Florida have an official three-day notice form?

Yes. Form 1, Notice From Landlord To Tenant – Termination For Failure To Pay Rent, is one of the landlord-tenant forms the Florida Supreme Court approved, and The Florida Bar posts it for free. Its text follows the statement Section 83.56(3) requires.

The form has blanks for the amount, the address with the county, the deadline date and the landlord’s contact details, plus a place to record whether it was hand delivered or posted.1–3

How can a Florida landlord deliver the three-day notice?

By mail, by handing a copy to the tenant, by email if both signed the email addendum described in Section 83.505, or, if the tenant is not home, by leaving a copy at the residence. A lease clause cannot remove these requirements.

Cities and counties cannot add their own notice rules: Section 83.425 reserves landlord-tenant notice requirements to the state.1,4,5

What to have at hand

  • Property address, unit and county
  • The exact rent past due and the rental periods it covers
  • Who takes the rent, where, and the hours for paying in person
  • Whether the property has a federally backed mortgage or a federal housing program

It does not evict anyone. Only a court can order a tenant out; this notice is the step that usually comes before filing.

Frequently asked questions

What if a Florida landlord accepts part of the rent after the notice?

The landlord keeps the right to evict but must do one of three things: give a receipt showing the amount, the new balance and the agreed date, deposit the partial payment with the court when filing, or post a new three-day notice for the new amount.1
