Questions about North Dakota
Who issues a certified North Dakota marriage record?
The county that sold and filed the marriage license. North Dakota Health and Human Services keeps a directory of county recorders and similar offices but does not issue the record itself.
There is no single state price. The department tells people to call the county for the fee because it differs from one county to the next.4
How soon must a North Dakota license show your married name?
Within 10 days. NDDOT says a driver license site must be visited to buy a corrected license in that window, and Section 39-06-20 of the Century Code applies the same ten days to a name “changed by marriage or otherwise.”
The statute treats the two kinds of change differently: a new address can go on a corrected card, but a new name requires a new license.1,2
What does North Dakota charge for the name change?
Three dollars, plus a new photo, when you are not renewing at the same visit. Section 39-06-49 sets that lower price for a substitute license that corrects a name or address; other substitutes cost $8.
Bring the certification itself: a government-issued marriage certificate, or a court order or divorce decree that is certified and sealed.1,2
Do you re-register to vote in North Dakota after marrying?
No. North Dakota is the one state without voter registration, so there is no voter record to amend. Voting depends on a valid ID: a North Dakota driver license or non-driver ID, a tribal ID or letter, or a long-term care certificate.
Carry the physical card, since NDDOT digital IDs are refused at the polls. A non-driver ID for voting is free, and a voter whose ID is not current can use a set-aside ballot and fix it within 13 days.6,7
What the North Dakota kit does, and what it doesn’t
- Form SS-5 filled in from your answersYou print it, sign it and bring it to Social Security with your documents. The form itself is free on ssa.gov.
- The passport application for your case, filled inPicked from your answers about your current passport; the State Department’s fees are paid to the State Department. The application also needs a recent color photo, which the kit doesn’t include: U.S. passport photo rules, and a photo from a selfie.
- The North Dakota checklistThe steps above in order, with the deadline, the fee and the official page for each one.
- Notification lettersFor your bank, employer, insurer and other accounts, with your old and new names.
The kit does not file anything for you and is not legal advice. Government fees, like the license fee and the county copy of your marriage record, are paid directly to each office.
Frequently asked questions
Can the North Dakota state vital records office send a marriage certificate?
No. North Dakota Health and Human Services says certified marriage records come only from the county where the license was purchased and filed, and it points you to that county for the price.4
Is the $3 North Dakota fee written in law?
Yes. Section 39-06-49 of the North Dakota Century Code charges three dollars for a substitute license that corrects a name or address, and NDDOT lists the same $3.00 for drivers who are not renewing.1,2
Will a North Dakota digital ID work at the polls after a name change?
No. The Secretary of State accepts regular and REAL ID cards issued by NDDOT but not its digital IDs, so vote with the physical license or non-driver ID.7
Does it cost anything to change your name with Social Security?
No. Social Security mails the card with the new name at no charge. The paper application, Form SS-5, is published by Social Security itself.5,9
Is there a fee to change the name on a new passport?
Not when the passport is less than a year old and the name changed within that year: Form DS-5504 has no fee unless you ask for expedited service or 1–2 day delivery.11
Can you bring a photocopy of your marriage certificate to Social Security?
No. Social Security accepts only originals or copies certified by the agency that issued them, and it refuses photocopies and notarized copies.3
